Private Conciliation
(Alternative Dispute Resolution – MASC)
As lawyers, we offer private conciliation services both to meet the legal requirement to use Appropriate Dispute Resolution Methods (Medios Adecuados de Solución de Controversias – MASC) under Law 1/2025 and in private disputes where the parties require a conciliator to help them reach an out-of-court settlement.
Since 3 April 2025, a key provision of Organic Law 1/2025 on the Efficiency of the Public Justice Service has been in force. It introduces the requirement to use Appropriate Dispute Resolution Methods (MASC) in civil and commercial matters before commencing court proceedings, with the aim of reducing litigation and speeding up dispute resolution.
As an alternative to lengthy, costly and sometimes unnecessarily contentious court proceedings, mechanisms such as mediation, arbitration and civil conciliation allow the parties to reach agreements more quickly, economically and collaboratively. Among these options, civil conciliation stands out for its simplicity, accessibility and effectiveness. Under the new legal framework, it is now required before court proceedings can be initiated in the relevant matters.
Civil conciliation is a straightforward, effective and cost-efficient way to resolve disputes without going to court. Although an agreement cannot always be guaranteed, the process itself can encourage dialogue, prevent unnecessary litigation and help both parties reach more satisfactory solutions. It is now a necessary step before bringing certain legal claims before the courts.
Both individuals and businesses should consider this option before initiating court proceedings, particularly in a legal framework that seeks to make the justice system more accessible, approachable and efficient.
